Why Register a Trademark?

Registration acts as a strong deterrent against copycats, builds consumer trust, and becomes a valuable business asset that can be licensed, franchised, or sold.

Who Can Apply?

Trademark registration in India is open to a wide range of applicants:

• Partnership firms and LLPs
• Private Limited and Public Limited companies
• Trusts, Societies and Section 8 Companies
• Foreign nationals and foreign companies (through an Indian agent)

Step-by-Step Registration Process

• 1. Trademark Search: Check the government IP India database to confirm your mark isn’t already registered or too similar to an existing one.
• 2. Filing the Application (Form TM-A): Submit the application online with your brand name/logo, applicant details, and the correct class of goods/services.
• 3. Examination: The Trademark Registry examines the application for conflicts and compliance. This typically takes 2–4 months.
• 4. Objection (if any): If the examiner raises an objection, a written response must be filed within 30 days, sometimes followed by a hearing.
• 5. Publication in the Trademark Journal: Once accepted, the mark is published for 4 months, during which third parties can oppose it.
• 6. Registration Certificate: If there’s no opposition (or it’s resolved in your favour), the Registry issues the registration certificate.

Documents Required

• Applicant ID proof (Aadhaar/PAN for individuals, incorporation certificate for companies)
• Address proof of the applicant
• Logo or wordmark image (if applying for a device/logo mark)
• List of goods/services the mark will be used for
• Udyam/MSME certificate (for discounted government fees, if applicable)
• Power of Attorney (Form TM-48) authorising your agent to file on your behalf

Government Fees

Official government fees (as of the current fee schedule) per class, per mark:

• Individual / Startup / Small Enterprise (with Udyam certificate): ₹4,500 (e-filing)
• Other applicants (companies, LLPs, partnerships without Udyam): ₹9,000 (e-filing)
• Additional class of goods/services: charged separately at the same per-class rate
• These are government fees only — professional/agent fees are charged separately

Timeline

• Filing to acceptance (if no objection): 4–6 months
• With objection/opposition: 12–24 months or longer
• A trademark is valid for 10 years from registration and can be renewed indefinitely in further 10-year terms
