Why every adult should have a Will and how to draft one that is legally valid and dispute-proof.
Why You Need a Will
Without a Will, your assets are distributed according to personal succession laws (Hindu Succession Act, Indian Succession Act etc.) which may not match your wishes. A Will ensures:
- Your exact wishes are carried out for all assets
- Reduces family disputes and litigation after death
- Protects interests of minor children and dependents
- Avoids long court procedures for surviving family members
- You can appoint an executor to manage asset distribution
Documents Needed for Will Drafting
- Identity proof of testator (person making Will)
- Details of all assets: property, bank accounts, investments, jewellery, business interests
- Names and identity details of all beneficiaries
- Details of any outstanding loans or liabilities
- Name and details of appointed executor(s)
- Two witnesses (who are NOT beneficiaries)
Registration vs Notarisation
- A Will does NOT need to be registered to be valid in India
- Registered Will: More difficult to challenge. Registered at Sub-Registrar office. Original kept in government records.
- Notarised Will: Less secure than registration. Can still be challenged.
- Recommendation: Always register your Will for maximum protection.
- Codicil: A document that amends an existing Will without making a new one.
Common Mistakes That Invalidate a Will
- Not having two witnesses present during signing
- Witnesses being beneficiaries of the Will
- Vague description of property (e.g. "my house" without clear address)
- Will made under undue influence or when not of sound mind
- Handwritten Will without witnesses (except privileged Wills for armed forces)
